Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Clutch (the “Service”) available at https://app-stg.clutchpredicts.com. By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Clutch provides features for making score predictions, joining leagues, viewing standings, and related social and competitive experiences. The Service, statistics, and displays may contain errors or delays. We may change, suspend, or discontinue features.

3. Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age required in your country (e.g. at least 16 in many regions, or 13+ with parental permission where required). The Service is not for users under 13.

4. Accounts and sign-in

You are responsible for your account credentials and for activity under your account. You may sign in with email/password and/or with Google. If you use Google sign-in, your use is also subject to Google’s terms and policies. You must provide accurate information and keep it up to date.

5. Acceptable use

You agree not to:

  • violate any law or third-party rights;
  • attempt to access accounts, systems, or data you are not authorized to use;
  • probe, scan, or test the vulnerability of the Service, or breach security or authentication measures;
  • interfere with the Service, impose an unreasonable load, or distribute malware;
  • harass, abuse, or harm other users; or
  • use the Service to build a competing product by scraping or automated means without our permission.

6. User content and conduct in leagues

You may see usernames, predictions, scores, and other user-generated information in shared leagues. You are responsible for your conduct and content you make available. We may remove content or suspend accounts for violations of these Terms or to protect the community.

7. No gambling; entertainment only

The Service is for entertainment, competition among friends, and bragging rights unless we explicitly state otherwise. Points and leaderboards are not a prize, currency, or monetary value, unless we clearly run a specific promotion with its own official rules. You are responsible for compliance with any laws in your location regarding prediction games or similar activities.

8. Intellectual property

The Service, including its design, branding, and software, is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use in line with these Terms. Match names, logos, and related marks may be owned by third parties; we do not claim ownership of third-party intellectual property.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be error-free, uninterrupted, or that results will be accurate. Third-party data (e.g. match data) may be delayed or incorrect.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT (IF ANY) OR (B) USD $100. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

11. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk, or for other operational or legal reasons. Provisions that by their nature should survive will survive termination.

13. Governing law; disputes

These Terms are governed by applicable law without regard to conflict of law principles. If you are a consumer, mandatory consumer protection laws in your country of residence may also apply. If you have a concern, contact us first at [email protected] so we can try to resolve it.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Continued use after changes means you accept the new Terms, except where your consent is required by law.
